This Consent Form (“Consent Form”) applies to the undersigned’s use of the Netradyne Driver•i. The undersigned represents and warrants that the undersigned has reached the age of majority and has the legal capacity to execute this Consent Form. You have been advised and understand that your employer or contractor utilizes Driver•i devices in its vehicles, and that Driver•i devices process outward-facing and inward-facing sensor data for certain purposes, including to detect safety events and create aggregated metrics. This Consent Form (“Consent Form”) applies to the undersigned’s use of the Netradyne Driver•i. The undersigned represents and warrants that the undersigned has reached the age of majority and has the legal capacity to execute this Consent Form.
You have been advised and understand that your employer or contractor utilizes Driver•i devices in its vehicles, and that Driver•i devices process outward-facing and inward-facing sensor data for certain purposes, including to detect safety events and create aggregated metrics. You understand that your fleet may have configured certain of its Driver•i devices so that VLS is enabled.
Purpose
VLS is a method for assigning a driver to driving data that is collected by a particular Netradyne Driver•i device that is installed in a particular vehicle. Alternative methods of driver assignment include use of beacons, integration with an Electronic Logging Device (ELD) system, and manual assignment by a dispatcher. VLS can work alone or in conjunction with alternative methods of driver assignment.
You have been advised and understand that VLS uses images of driver faces to authenticate drivers of vehicles. Your employer or contractor has contracted with Netradyne to use VLS for its vehicles. Netradyne will, using the inward-facing camera of the Driver•i device, collect one or more images of your face while you are driving.
- If you choose to use VLS, then in connection with your use of VLS and based on these images, Netradyne may derive a scan of your face geometry or similar biometric data (“Authentication Information”) for authentication purposes, specifically to distinguish a subsequently collected image of your face from that of other drivers who are active with your employer or contractor.
- If you choose not to use VLS, then the Driver•i devices in your employer’s or contractor’s fleet will be unable to authenticate you based on an image of your face.
Data Retention
Netradyne may retain your Authentication Information until Netradyne receives written notice from your employer or contractor that the initial purpose for collecting or obtaining such Authentication Information has been satisfied, such as the termination of your employment with Netradyne’s client, when you move to a role within the client for which the Authentication Information is not used, or the client has discontinued using Netradyne’s services for which the Authentication Information was used. Additionally, to the extent required by applicable law and Netradyne’s contractual obligations to your employer or contractor, Netradyne may delete your Authentication Information within 3 years of your last interaction with a VLS-enabled Driver•i device, or within another duration as may be required by law or Netradyne’s contractual obligations.
In addition, as explained below, some inward-camera image data may be deidentified and retained by Netradyne for as long as permitted by law to improve Netradyne’s services.
Consent
The processing that supports VLS is intended to authenticate you based on an image of your face. Your use of VLS may constitute the collection, storage, use, and/or retention of a biometric identifier or biometric information under various laws, including the Illinois Biometric Information Privacy Act, 740 ILCS 14/1, et seq. (“BIPA”), the General Data Protection Regulation (“GDPR”), and the Act Respecting the Protection of Personal Information in the Private Sector, CQLR P-39.1 (“the Quebec Private Sector Act”).
By signing below, you voluntarily consent to the collection, use, retention, and disclosure of your biometric identifiers and biometric information by Netradyne and your employer or contractor whenever you drive a VLS-enabled vehicle. You further voluntarily consent to Netradyne providing such biometric identifiers and identifiers to its vendors and service providers in connection with providing VLS.
Use of Images of You To Improve VLS
If you choose to use VLS, Netradyne may retain deidentified images of you (that are not stored with your name or other identifiers) and may use such deidentified images for the purpose of improving Netradyne’s VLS technology. If you choose not to allow Netradyne to retain deidentified images of you for the purpose of improving Netradyne’s VLS technology generally, then VLS may not work as accurately as it would otherwise for you and for other people having a similar appearance. You may opt-out of this use and still use VLS by contacting privacy@netradyne.com.
You understand that such opt-out(s) will apply only to images of you collected and retained after your opt-out request has been received. Your opt-out would not apply to images collected before the opt-out request has been received because the images are deidentifed and can no longer be associated with the requestor.
